GREENE COUNTY COMMISSION

SUBJECT: Sunshine Law Policy
WHEREAS, Section
610.013.1 RSMo. provides that a public governmental body is to appoint a custodian
who is to be responsible for the maintenance of the body’s records and the
identity and location of the custodian is to be made available upon request,
and
WHEREAS, Section
610.026.1 RSMo. (as amended 1998) provides that except as otherwise provided by
law, each public governmental body shall provide access to and, upon request,
furnish copies of public records subject to the payment of fees for the copying
or duplication of said records; and
WHEREAS, Section
610.028.2 RSMo. provides that a public governmental body shall provide a
reasonable written policy in compliance with Sections 610.010 to 610.030 RSMo.,
commonly referred to as the Sunshine Law, regarding the release of information
on any meeting record or vote.
NOW, THEREFORE, BE IT
RESOLVED:
1. That
the Greene County Clerk be and hereby is appointed custodian of the records of
the Greene County Commission and such custodian is located at the Greene County
Courthouse, 940 Boonville, Springfield, Missouri 65802.
2. That
said custodian shall respond to all requests for access to or copies of a
public record within the time period provided by statute except in those
circumstances authorized by statute.
3. That
the fees to be charged for copying public records or providing access to public
records maintained records subject to the payment of fees for the copying or
duplication of said records; and on computer facilities, recording tapes or
disks, video tapes or films, pictures, slides, graphics, illustrations or
similar audio or visual items or devices, shall include only the cost of
copies, disk or tape used for the duplication, and staff time required to make
copies and programming. Fees shall be
as hereinafter provided, which fees have been determined not to exceed the
actual cost of document search and duplication:
• Photocopy expense of 10˘ per page.
•
Staff
time required to prepare request shall be prorated at $10 per hour. Such fee beginning after fifteen minutes
has elapsed.

4. Upon
request, the Greene County Commission shall certify in writing that the actual
cost of document search and duplication is fair, reasonable, and does not
exceed the actual cost incurred by the County Commission.
5. That
it is the public policy of the Greene County Commission that meeting records,
votes, actions and deliberations of this body shall be open to the public
unless otherwise provided by law.
6. That
the Greene County Commission shall comply with Sections 610.010 to 610.030
RSMo. (as amended 1998), the Sunshine Law, as now existing or hereafter
amended.
